LCE Healthcare Policy & Procedures

Level 2 Background Check Policy

Effective Date: November 1st 2025
Approved By: Executive Management Compliance – LCE Healthcare
Applies To: All LCE Healthcare Employees, Contractors, and Providers

Provider Cost: $183.60 per background check

Purpose

 The purpose of this policy is to ensure that LCE Healthcare maintains the highest standards of safety, integrity, and compliance by verifying the background and suitability of all individuals providing healthcare, administrative, or support services under the organization.


This policy establishes the procedures for conducting Level 2 Background Checks for all personnel occupying positions of trust, including those who provide direct or indirect care to patients, handle sensitive information, or work with vulnerable populations..

Policy Statement

 All employees, contractors, volunteers, and healthcare providers affiliated with LCE Healthcare are required to complete a Level 2 Background Check prior to engagement or employment.


This requirement is in accordance with state and federal regulations governing positions of trust in healthcare, education, and social services. The Level 2 Background Check process uses fingerprint-based national and state criminal record searches and may include verification of employment, education, and professional credentials.

A Level 2 Background Check is a comprehensive, fingerprint-based screening used to evaluate an individual’s criminal history and professional background. It is designed to ensure that individuals employed or contracted by LCE Healthcare meet the ethical and legal standards expected in the healthcare profession.


The Level 2 Background Check Includes:

  • Fingerprint-Based Criminal History Check: Searches both state and federal criminal databases for felony or misdemeanor convictions.
     
  • County and State Record Review: Examines local and statewide court and law enforcement databases for criminal activity.
     
  • Disqualifying Offenses: Identifies criminal convictions that may disqualify an applicant from employment, which typically include violent crimes, sexual offenses, crimes involving abuse, or crimes against vulnerable populations.
     
  • Verification Checks: May include validation of education, employment history, and professional licenses when applicable.

 The following categories of individuals are required to successfully complete a Level 2 Background Check prior to onboarding:


  • Healthcare Professionals: Physicians, nurses, medical assistants, behavioral health specialists, and telehealth providers.
     
  • Administrative Personnel: Individuals with access to patient data or sensitive information.
     
  • Education & Training Staff: Individuals involved in patient or provider education.
     
  • Childcare or Youth Service Providers: Personnel involved in family health or youth programs.
     
  • Support Staff Working with Vulnerable Populations: Those who interact with the elderly, disabled, or other at-risk individuals.

Procedure

Disqualifying Offenses

 Initiation:
Upon conditional offer of employment or contract engagement, the Human Resources Department will initiate the Level 2 Background Check.
 

Consent:
The applicant must complete and sign an authorization and consent form allowing LCE Healthcare to conduct the screening.
 

Fingerprinting:
The applicant will be scheduled to provide fingerprints through an authorized vendor for submission to state and federal agencies.
 

Processing:
The background check will be processed through approved databases, including the FBI and applicable state law enforcement agencies.
 

Review of Results:
 

  • HR will review the background report for disqualifying offenses.
     
  • If any potentially disqualifying information is found, HR will consult with LCE Healthcare’s Compliance Officer for determination.
     

Notification:
Applicants will be notified in writing of their background check results. If disqualified, they will be informed of their right to appeal or request an exemption (if allowed under state law).

Disqualifying offenses vary by jurisdiction but may include:


  • Murder, manslaughter, or kidnapping
     
  • Abuse or neglect of a child, elder, or disabled individual
     
  • Sexual assault or any sex-related crime
     
  • Crimes involving violence, fraud, or theft
     
  • Drug trafficking or illegal substance manufacturing
     

LCE Healthcare reserves the right to disqualify applicants for other serious offenses that may compromise patient safety or organizational integrity.

Pass: The applicant is cleared for employment or contractual engagement.
 

Fail: The applicant is disqualified due to a disqualifying criminal history or falsification of information.
 

Appeal: In states that allow exemptions (e.g., Florida), the applicant may submit an appeal demonstrating rehabilitation, time elapsed since conviction, or evidence of good conduct.

Return and Refund Policy

 

LCE Healthcare Refund and Cancellation Policy

Effective Date: November 6th 2025
Applies To: All Patients, Providers, and Service Users of LCE Healthcare


1. Purpose

The purpose of this policy is to establish fair and transparent guidelines for cancellations, refunds, and returns related to LCE Healthcare’s patient telehealth services and provider subscription or service fees. LCE Healthcare is committed to delivering professional, compliant, and customer-focused healthcare experiences while maintaining compliance with all applicable federal and state healthcare regulations.


2. Terms of Return and Cancellation

For Patients (Telehealth Appointments & Services):

  • Appointments may be cancelled or rescheduled up to 24 hours prior to the scheduled session without penalty.
  • Cancellations made less than 24 hours before the appointment may be subject to a late cancellation fee (up to 50% of the appointment cost).
  • If a provider cancels or fails to appear for a scheduled telehealth session, the patient will be entitled to a full refund or credit toward a future appointment.
  • Refund requests must be submitted within 30 days of the original appointment date.
     

For Providers (Membership, Setup, or Subscription Services):

  • Providers subscribing to LCE Healthcare platform services (credentialing, access, or listings) may cancel their subscription with 30 days’ written notice.
  • Any setup or credentialing fees are non-refundable once services have commenced.
  • Monthly subscription fees will be refunded on a prorated basis only if cancellation occurs before the next billing cycle.
  • Provider accounts found in violation of compliance or credentialing requirements may be suspended or terminated without refund.
     

3. State and Condition of Return

As LCE Healthcare operates in the healthcare and telehealth sector, all services are considered professional service transactions, not physical goods. Therefore, refunds are issued only for unrendered or incorrectly billed services and not for completed medical consultations or digital health interactions.

Refund eligibility applies when:


  • Services were billed in error or duplicated.
  • The provider was unavailable or unable to deliver the agreed service.
  • A technical failure (not attributable to patient error) prevented the service from being rendered.
     

4. Process for Requesting a Refund or Cancellation

To initiate a refund or cancellation request:


  1. Contact LCE Healthcare Customer Service via email at support@lcenewportbeach.com or by phone at (725) 294-9379.
  2. Provide your full name, contact information, transaction date, and reason for the request.
  3. Attach any relevant receipts, appointment confirmations, or reference numbers.
  4. The LCE Healthcare billing team will review your request within 5–7 business days and provide written confirmation of approval or denial.
     

If approved, the refund will be processed in accordance with Section 5 below.


5. Refund Terms and Duration

  • Approved refunds will be issued to the original form of payment within 10–14 business days of approval.
  • Credit card refunds may take additional time depending on the issuing bank.
  • Refunds for electronic payments (PayPal, Stripe, etc.) will be processed directly through the respective platform according to their policies.
  • Patients may request a service credit in lieu of a cash refund for use toward future consultations or wellness services.
     

6. Exceptions

Refunds will not be issued for:


  • Completed telehealth or in-person consultations.
  • Missed appointments without prior cancellation notice.
  • Subscription fees after service period completion.
  • Administrative fees related to credentialing, compliance review, or payment processing.

8. Acknowledgment

By using LCE Healthcare’s services, patients and providers acknowledge that they have read, understood, and agree to the terms outlined in this Refund and Cancellation Policy.

(Private Policy Between LCE Healthcare and Its Patients)

LCE Healthcare (“LCE,” “we,” “our,” or “us”) is committed to protecting the privacy, security, and confidentiality of all patient information entrusted to our care. This Privacy Policy outlines how LCE Healthcare collects, safeguards, uses, and protects patient information across our telehealth, clinical, and administrative services.

1. Patient Confidential Information

“Patient Confidential Information” includes, but is not limited to:

  • Medical records, clinical notes, diagnostic information, and treatment history
  • Personal identifying information (name, address, phone number, date of birth)
  • Health insurance information and billing data
  • Telehealth visit information, provider communications, and consultation records
  • Prescription and medication information
  • Any information shared through LCE Healthcare’s telehealth platform, patient portal, or digital communication tools
  • All protected health information (“PHI”) as defined under HIPAA
     

All Patient Confidential Information is the exclusive property of the patient and shall be handled only in accordance with federal and state laws, including HIPAA.


2. Use of Patient Information

LCE Healthcare may use patient information only for legitimate healthcare purposes, such as:

  • Providing medical evaluation, telehealth visits, treatment, and follow-up care
  • Coordinating care with authorized providers or specialists
  • Processing insurance claims, billing, or administrative operations
  • Complying with state and federal healthcare regulations
  • Improving clinical quality and patient experience
     

LCE will never sell, license, trade, or misuse patient health information under any circumstances.


3. Patient Consent

By receiving services from LCE Healthcare, the patient acknowledges and agrees that:

  • Their information may be used for treatment, payment, or healthcare operations
  • LCE Healthcare may contact them regarding appointments, results, medication updates, or care coordination
  • No information will be shared with unauthorized parties without written consent
     

Patients may withdraw consent in writing at any time, except where prohibited by law.



4. HIPAA Compliance

LCE Healthcare fully complies with:

  • The Health Insurance Portability and Accountability Act (HIPAA)
  • Federal and state medical privacy standards
  • All telehealth privacy and security laws
     

We maintain encrypted systems, secure medical devices, and protected telehealth platforms to ensure maximum patient safety.


5. Privacy Protections for Telehealth Services

LCE Healthcare uses a HIPAA-compliant telehealth platform to ensure:

  • Encrypted video sessions
  • Secure storage of medical documentation
  • Restricted access to authorized medical personnel only
  • Secure messaging and communication protocols
     

Patients are encouraged to participate in telehealth visits from a private location to maintain confidentiality.


6. Patient Rights

Each patient has the right to:

  • Access and obtain copies of their medical records
  • Request amendments or corrections
  • Request restrictions on disclosures
  • Receive a list of any authorized third-party disclosures
  • File a privacy complaint without fear of retaliation
     

LCE Healthcare will honor all reasonable requests in accordance with HIPAA.


7. Data Retention & Destruction

LCE Healthcare retains patient records for the duration required by federal and state law.


Upon expiration of legal requirements:

  • Records are permanently deleted or securely destroyed
  • No physical or electronic copies are stored, shared, or archived beyond compliance requirements
     

8. Data Breach Notification

In the event of a suspected or confirmed security breach involving PHI:

  • LCE Healthcare will immediately investigate and mitigate the issue
  • Affected patients will be notified promptly
  • Required authorities will be notified in accordance with HIPAA Breach Notification Rules
     

9. Third-Party Access Restrictions

Unless explicitly authorized by the patient in writing:

  • No external business, partner, contractor, family member, or organization may access patient records
  • No information may be released to employers, insurance companies, or government agencies except where required by law
     

LCE Healthcare does NOT share patient information with any non-healthcare business.


10. Enforcement & Remedies

Any violation of this Private Policy:

  • Will trigger immediate corrective action
  • May result in suspension or termination of personnel involved
  • May involve legal or regulatory enforcement measures


Patients harmed by a privacy failure may be entitled to remedies as permitted by law.
